Scope & Agreement

These terms apply when you use the D Flasher website, D Flasher social media pages, the D Flasher mobile application, or services made available through the application, website, email or phone.

By proceeding with D Flasher software or purchasing D Flasher products, you acknowledge these Terms and agree to comply with them.

D Flasher is operated by 2859910 Ontario Inc., referred to in these Terms as the Company.

Lawful Use

D Flasher products are not intended to be used for unlawful purposes.

By purchasing or using a D Flasher product, you agree to use it only in a lawful manner and accept responsibility for determining whether your intended use complies with the laws that apply in your jurisdiction.

If you are uncertain about the legality of a planned modification or use, you should obtain independent legal advice before proceeding.

Competition & Off-Road Products

Certain D Flasher products are not designed or permitted for use on street-compliant or pollution-controlled vehicles.

Products identified for closed-course or off-road competition use must only be used in a manner that complies with applicable law and regulatory exemptions.

Such products must not be used on public roads or highways where that use is prohibited.

Emissions Compliance

By purchasing or activating D Flasher products, including software, you certify that they will be used for lawful purposes.

D Flasher products must not be used to defeat, disable, remove or interfere with original manufacturer emissions-control equipment or emissions performance when doing so would violate the U.S. Clean Air Act or any other applicable law.

Users are responsible for confirming compliance with all applicable emissions and environmental laws before purchasing, installing or using a product.

Disclaimer of Warranties

D Flasher products, application materials and services are provided on an "as is" and "as available" basis to the extent permitted by law.

The Company does not guarantee that all information, materials, products or services provided through the application will be free of errors or suitable for every particular vehicle, configuration or intended use.

It is your responsibility to determine whether a D Flasher product, service or piece of information meets your requirements before using it.

D Flasher is also not responsible for the content or practices of third-party websites linked from its services.

Damages & Limitation of Liability

To the extent permitted by applicable law, 2859910 Ontario Inc. is not responsible for losses or damages resulting from the use of, inability to use, improper use of, or modifications made using D Flasher products or information.

The Company does not assume responsibility for delays involving delivery, installation or product use, vehicle performance, service life, incorrect installation, inaccurate information, or damage caused by use or misuse of a product.

Modifications and installations are performed at the customer's or end user's own risk.

Local Laws & Regulations

D Flasher does not guarantee that any particular software modification is legal for use on a street-driven vehicle.

Customers and installers are responsible for checking applicable regulations before purchasing, installing or using a product.

D Flasher is not responsible for fines, penalties or other consequences resulting from a user's failure to comply with applicable laws.

Manufacturer Warranty

D Flasher does not guarantee that the use or installation of D Flasher products will comply with a vehicle manufacturer's warranty or service agreement.

Software changes or other modifications may affect or void portions of a vehicle's factory warranty.

The customer or end user is responsible for understanding the effect that a modification may have on manufacturer warranty coverage.

Vehicle Modification Risks

Modified vehicles may require additional hardware, supporting modifications, maintenance or monitoring.

Results can vary based on factors including:

• Vehicle configuration and existing modifications.
• Quality of installation.
• Vehicle health and maintenance.
• Environmental conditions.
• Testing equipment and procedures.

Vehicle modification involves mechanical and safety risks. These may include reduced performance, engine or transmission failure, fire, vehicle damage or personal injury.

The user accepts responsibility for understanding these risks before proceeding with a modification.

Currency

Unless otherwise stated, prices and transactions on the D Flasher website are listed and processed in United States Dollars (USD).

D Flasher operates in Canada but uses USD as its standard transaction currency.

Exchange rates may vary and your bank, card issuer or other financial institution may charge foreign exchange or transaction fees.

D Flasher is not responsible for exchange-rate differences or additional conversion fees charged by financial institutions.

Returns & Refunds

Returns of an unused license may be requested within 14 days of the purchase date.

• Shipped adapters cannot be returned.
• Shipping and duty charges are not refundable.
• A 20% restocking fee applies to returns.
• Discounted orders are not eligible for return.

To request a refund, contact D Flasher and include your order number.

Please submit only one return request for an order to avoid processing delays.

Refunds are issued after a return is accepted. Bank processing time and applicable banking fees may affect when the refund is received and the final amount credited.

Privacy

Use of the D Flasher application, website and related services is also subject to the D Flasher Privacy Policy.

D Flasher collects and processes personal information in connection with its products and services as described in that policy.

Agreement to These Terms

By selecting "I Agree" or otherwise proceeding with the use of D Flasher, you confirm that you have reviewed and accepted these Terms.

You also acknowledge responsibility for actions performed using the software and understand that vehicle modification may involve both legal and mechanical risks.
